What Developments for the European Framework on Enforcement of Intellectual Property Rights? A Comment on the Evaluation Report Dated December 22, 2010

Within the framework of the evaluation of Directive 2004/48 on the enforcement of intellectual property rights, the European Commission published a report onDecember 22, 2010 concerning the implementation of this text by the Member States,3 inviting all interested parties to submit their comments in order to give greater depth to the process of evaluation and "with a view to informing the Commission's decision on any future measures that might be envisaged". The present article takes up a number of the questions raised by this report and contains a certain number of comments on possible developments of the European legal framework for the enforcement of intellectual property rights.
