There are significant shortfalls in the enforcement of regulatory data protection (RDP) rights in the European Union. While the EU claims it is encouraging innovation by protecting intellectual property (IP) rights, infringements of RDP rights by generics companies can and do occur in practice when "abridged" marketing authorisations are inappropriately granted.
