The case was a direct action under Article 258 TFEU brought by the Commission, seeking a declaration that the UK had failed to fulfil its obligations in respect of Article 4(3) and Annex VI, Part A of Directive 2001/80/EC on the limitation of emissions of certain pollutants into the air from large combustion plants (the Directive). The failure was alleged to apply to Aberthaw power station in Wales (Aberthaw).
