ETS extended to aviation after ECJ ruling rejecting appeal

The EU's emissions trading scheme (ETS) was extended to aviation on 1 January following a late December ruling in the European Court of Justice (ECJ) rejecting an appeal from US and Canadian airlines. In the ruling interpreting the legality of the 2008 directive (2008/101) extending the 2003 ETS to aviation, the Court found "Application of the emissions trading scheme to aviation infringes neither the principles of customary international law at issue nor the Open Skies Agreement."
