A federal district court's dismissal of a climate change tort lawsuit, in which Mississippi property owners alleged that a group of energy companies should be held liable for hurricane damage, will remain in force as the U.S. Supreme Court announced Jan. 10 that it has denied a petition to overturn the ruling (In re: Comer, U.S., No. 10-294, petition for writ of mandamus denied 1/10/10). The case was the second in which petitioners have asked the Supreme Court to review an appeals court decision regarding lawsuits against emitters of greenhouse gases. The issue in this case was whether the U.S. Court of Appeals for the Fifth Circuit's decision to dismiss for lack of a quorum of judges was proper.
