Seventh Circuit Rejects EPA Petition For Rehearing in New Source Review Case

A federal appeals court denied a request by the Environmental Protection Agency to rehear a July ruling that said the government's lawsuit alleging new source review violations by a Midwest utility was filed beyond the five-year statute of limitations (United States v. In a decision handed down Sept. 20, the U.S. Court of Appeals for the Seventh Circuit rejected the EPA's petition for a rehearing of its earlier ruling that affirmed a district court decision that the government's lawsuit was untimely.
