Los Angeles County Liable for Violating Stormwater Permit, Ninth Circuit Rules Again

The Los Angeles County Flood Control District is liable for violating its stormwater discharge permit when the monitoring data it collects show pollution levels in waterways exceed permitted levels, a federal appeals court ruled Aug. 8 (NRDC v. Cnty. of Los Angeles, 9th Cir., No. 10-56017, 8/8/13). The decision from the U.S. Court of Appeals for the Ninth Circuit hands environmental groups a victory in their long-running lawsuit to force the county to clean up tainted runoff that spills from miles, of storm drains into the Los Angeles and San Gabriel rivers and eventually the Pacific Ocean.
