State Appeals Court Denies Rehearing In Decision on Low-Carbon Fuel Standards

A California appeals court has denied a petition from the California Air Resources Board to rehear a case on implementation of the state's low-carbon fuel standards (POET LLC v. CARB, Cal. Ct. App., No. F064045, rehearing denied 8/8/13). The Aug. 8 order from the California Court of Appeal, Fifth District, means the court's July 15 ruling that the air board violated the California Environmental Quality Act (CEQA) and the federal Administrative Procedure Act (APA) in approving the low-carbon fuel standards will stand.
