U.S. Appeals Court Denies Rehearing on Low-Carbon Fuel Standard Rule

The U.S. Court of Appeals for the Ninth Circuit on January 22 denied a petition brought by the American Fuel & Petrochemical Manufacturers (AFPM) for a full “en-banc” rehearing of an earlier three-judge panel decision that upheld the California Air Resources Board “low carbon fuel standard” (LCFS) rule. Reacting to the denial, AFPM General Counsel Rich Moskowitz said that the LCFS rule “clearly discriminates against fuels produced in other states and violates the Commerce Clause of the U.S. Constitution.”
