D.C. Circuit Should Deny Rehearing Petition In RCRA Case, Environmental Groups Say

Environmental advocates are urging a federal appeals court to reject an industry petition to rehear arguments in a case where the court struck down an Environmental Protection Agency hazardous waste regulation (Sierra Club v. EPA, D.C. Cir., No. 08-1144, 9/2/14). In a Sept. 2 response filed with the U.S. Court of Appeals for the District of Columbia Circuit, the Sierra Club and Louisiana Environmental Action Network argued that the court ruled properly in the case and said its decision doesn't conflict with earlier decisions, as the industry groups had alleged.
