D.C. Circuit Denies Environmentalists' Rehearing Bid In ELG Records Suit

The U.S. Court of Appeals for the District of Columbia Circuit has rejected environmentalists' bid to rehear their suit seeking the release of materials EPA used to develop its 2015 Clean Water Act (CWA) effluent limits for power plants, effectively ending the suit unless the Supreme Court decides to take it up. In a Sept. 1 order, the court rejects without comment the petitioners claims in Environmental Integrity Project, et al, v. EPA that a three-judge D.C. Circuit panel erred in holding that a disclosure exemption in the Freedom of Information Act (FOI A) takes precedence over CWA mandates to release data on power plants' wastewater.
