Governor Signs Legislation Boosting Brownfield Projects, Reclaimed Water Use

Brownfield redevelopers in Florida will get increased liability protection, and the state will study the potential for increased usage of reclaimed water, under two new laws that Florida Gov. Rick Scott (R) signed June 13. H.B. 325, which takes effect on July 1, provides that redevelopers of Florida brownfield sites aren't liable for property damages claimed by neighboring property owners, such as decreased property value or loss of rental or sale income, so long as the redevelopers follow the site rehabilitation agreement approved by the Florida Department of Environmental Protection. Current law only provides redevelopers with protection from liability for further site remediation after completing their rehabilitation agreement (45 ER 1435, 5/9/14).
