A federal district court in New York has remanded to the Environmental Protection Agency for reconsideration a 2008 rule (40 C.F.R. 122.3(i)) stating that permits are not required for transfers of water from one body of water to another (Catskill Mountains Chapter of Trout Unlimited Inc. v. EPA, S.D.N.Y., No. 08-CV-5606, 3/28/14). The March 28 decision by Judge Kenneth M. Karas of the U.S. District Court for the Southern District of New York returned the water transfers rule to the agency to develop "a reasoned explanation" for its interpretation of the phrase "navigable waters."
