In an unusual alliance with Duke Energy Corp., environmental groups are claiming victory over a North Carolina agency assigned to oversee the cleanup of coal ash disposal ponds after a major spill last year. Wake County Superior Court Judge Paul Ridgeway said in a hearing Sept. 14 he is inclined to agree with Duke and the groups that the utility owner should drain and remove coal ash ponds at seven power plants, three more than required by a state law following the spill from an abandoned Duke plant on the Dan River, according to Nick Torrey, a staff attorney for the Southern Environmental Law Center.
