Citizens Can't Intervene to Speed EPA Superfund Cleanup

It's too late for frustrated residents to intervene in Superfund litigation against Atlantic Richfield Co. and E.I. Du Pont De Nemours & Co. over delays in cleaning up pollution at a Superfund Site in East Chicago, Ind., a federal court in Indiana ruled Feb. 9. The USS Lead Superfund Site has seen more than a century of lead and arsenic contamination-and EPA only recently took remedial steps despite knowing about the pollution for decades-but court rules barred intervention in the case closed by consent decree three years ago, the court said.
