摘要

Mining company is liable for full amount of costs federal government incurred at two contaminated mining sites, because: (1) even though company alleged government knew mine produced tailings that were stored on site, company did not establish that government intended to dispose of waste for mine operator and is itself liable as party that arranged for disposal of hazardous substances at sites; (2) company did not establish reasonable basis for apportioning costs at sites, and (3) company did not establish that removal action at one site was inconsistent with national contingency plan.
