LEGALITY OF EPA MULTI-POLLUTANT PLANNING EFFORT IN DOUBT IN KEY PILOTS

Questions about the legality of EPA's effort to shift away from single-pollutant regulation toward comprehensive, multi-pollutant air quality management are among several key issues raising doubts about the success of a new EPA/state pilot program designed to lay the groundwork for the long-sought multi-pollutant approach, sources familiar with the effort say. Because of the legal constraints, participants in the pilot programs will have to do their multi-pollutant planning in addition to their Clean Air Act mandates to address criteria pollutants and air toxics under separate, resource-intensive plans.
