EPA SEEKS LAWSUIT DELAY TO REVIEW BUSH 'COMPARABLE FUELS' RULE

The Obama EPA is seeking an unusual one-year delay to a lawsuit activists filed against the Bush agency's last-minute controversial "comparable fuels" rule that increased the number of hazardous wastes that can be burned as fuel without being subject to strict federal waste-management requirements.rnThe Department of Justice (DOJ) on behalf of EPA filed an unopposed April 16 motion with the U.S. Court of Appeals for the District of Columbia Circuit to hold the suit in abeyance for one year while the new administration reviews the rule. The motion in Louisiana Environmental Action Network (LEAN), et al. v. EPA, et al. - filed on the eve of an April 20 deadline to intervene in the suit - says the delay is vital given the "concomitant possibility that the regulation might be altered or withdrawn" once EPA completes its review.
