States, industry groups and environmentalists are raising questions over whether EPA and the Army Corps of Engineers' Clean Water Act (CWA) jurisdiction rule - stayed by a federal appeals court - should apply to the Corps' recent proposal to reissue a slew of streamlined nationwide permits (NWPs) for a host of activities. For example, the American Petroleum Institute in Aug. 1 comments on the NWP proposal warns that even though the U.S. Court of Appeals for the 6th Circuit has blocked implementation of the jurisdiction rule pending the end of litigation over it, many "critical definitions" such as "waters of the U.S." appear in the NWP plan.
