Midwest Utilities Warn EPA Over Aggressive Ozone Deal With Eastern States

The Midwest Ozone Group (MOG) of utilities and industrial companies is criticizing as unlawfully aggressive EPA's proposed consent decree with East Coast states setting deadlines for agency action on state plans to mitigate interstate ozone pollution, escalating the group's fight against EPA interstate ozone reduction mandates.While EPA has missed statutory deadlines to review state plans, MOG charged in part the proposed decree is unlawful because it provides EPA with a means of imposing federal requirements even though it may not have disapproved any state plans.But while the industry group says the proposed decree is unlawfully strict, some states, like Wisconsin, are urging EPA to strengthen it further, calling for the agency to take action sooner than what is outlined in the draft version.
