Courts Demand Greater Burden of Proof in Evaluating Delay Damages

At the American Bar Association Forum on the Construction Industry's 2013 Midwinter Meeting, construction law experts tackled the complex but critical task of proving damages incurred by contractors due to delays resulting from circumstances beyond their control. The speakers at the Midwinter Meeting plenary session on "Delay Damages-What's Hot, What's Not" pointed out that knowing who is at fault in a claim is only half the battle. The bigger question and much larger point of contention is the ability to document the amount of damage suffered.
