Design firms are seeing a relatively new line item in the insurance section of their contracts for various cyber insurance coverages. Owners, inherently adverse to risk, take a familiar approach in dealing with the developing exposure of cyber claims by contractually transferring this risk to design professionals in the robust indemnification provisions in most agreements. The uncertainty of an owner's cyber exposure now becomes the design firm's obligation that needs to be properly insured.
