Disease remains unknown by the general public and surrounded by myths about their symptoms and limitations, autism needs special attention of the Executive Branch to implement public policies able to meet satisfactorily the carriers of this disorder. The omission of the Legislature or proven inefficiency of the measures he implemented in health care and education of autistic born power / duty of the judiciary to ensure the rights of this group and their families. The judicial activism in the case of implementation of public policies related to autism, will be analyzed from specific decisions of the Courts of Justice of S?o Paulo and Rio Grande do Norte, in a comparative way, to point a solution that is more consistent with the constitutional project.
