O seguro ambiental no Brasil e a sua implanta??o dentro de um contexto de responsabilidade civil

div align="justify"O objetivo desta exposi??o é abordar as quest?es relacionadas à implanta??o das bases para o seguro ambiental no Brasil. Com isso pretende-se chamar a aten??o dos profissionais do direito, da engenharia, industriais e empresários em rela??o ao direito coletivo do meio ambiente. Um direito que pertence a todos, e ao mesmo tempo a cada um, pois todos têm o benefício de viver num meio circundante ecologicamente equilibrado, um habitat, que ainda seja natural, e que forne?a ao ser humano a melhor qualidade de vida possível. O direito de um meio-ambiente sadio, no Brasil, está consagrado na Constitui??o Cidad? de 1988, que no seu artigo 225 garante a responsabiliza??o dos infratores em reparar os danos causados (§3o, art. 225, CF/88). Para tanto, é necessário entender os conceitos relacionados ao instituto da responsabilidade, principalmente a responsabilidade civil já que é ela quem assegura o re-estabelecimento do estado anterior ao dano ou ent?o, a repara??o pecuniária satisfatória ao dano causado, a exemplo do seguro ambiental, que pode até mesmo a vir a se tornar obrigatório por meio de leis, que est?o em tramite no Congresso Nacional.Palavras-chave: seguro ambiental; implanta??o; responsabilidade civil; dano ambiental./div/pbr/pABSTRACT/Pdiv align="justify"The objective of this exposition is to approach the questions related to the implantation of the bases for the environmetal insurance in Brazil. With this it is intended to call the attention the professionals of the right, of engineering, industrials and entrepreneurs in relation to the collective right of the environment. A right that belong to all and at the same time to each other, because all the benefit of living in a surrounding way ecological balanced, a habitat, that still is natural, and that it supplies to the human being the best quality of possible life. The right of a healthy half-environment, in Brazil, is consecrated in the Constitution Citizen of 1988, that in its article 225 it guarantees the responsibility of the infractors in repairing the actual damages (§3o, art. 225, CF/88). For in such a way, it is necessary to understand the concepts related to the institute of the responsibility, mainly the civil liability since who is it assures the re-establishment of the previous state to the damage or then, the satisfactory pecuniary repairing to the actual damage, the example of the ambient insurance, that can even though come if become obligator by means of laws, that are in proceeding in the National Congress.Keywords: environmental insurance; implantation; civil liability; ambient damage./div
