A High Court judgment has recently ruled that Corby Borough Council (CBC) could be liable in negligence for birth defects suffered by children born in the vicinity of a CBC remediation project in the 1980s and 1990s. The claimants allege that during pregnancy their mothers were exposed to toxic materials released from the project. The case is hugely important for operators, such as waste contractors, who have had to manage contaminated soils/materials in the past. In particular, the case raises the possibility of current liabilities arisingrnout of historic activities, which may have been regarded as normal practice at the time.
