Government Loses Legal Challenge to Firm's Teaming Agreement

In these new economic times, many general contracting firms and subcontractors that typically do not bid on public contracts have been looking to federal construction projects to help fill the void created by the paucity of private commercial opportunities. Because public projects are so competitive and there is a commensurate need for an edge in the bidding, construction firms have been turning to teaming arrangements and joint venture partnerships in an effort to make a strong showing in the bidding process. Teaming agreements provide opportunities for both sides. Prime contractors that are large enough to secure bonding and manage performance but lack the technical expertise in a particular area may benefit from agreements with specialty subcontractors to perform certain parts of the work. Conversely, teaming agreements allow smaller firms to participate, gain experience, and profit from projects that would typically be too large for them on their own.
