Agreement Ends Litigation Regarding EPA's Construction Effluent Guidelines

UNDER THE TERMS of a recent settlement, the U.S. Environmental Protection Agency (EPA) is required by mid-April to begin the process of amending its controversial effluent guidelines for the construction and development industry. The changes are intended to address industry concerns regarding the effluent guidelines. In particular, industry representatives have challenged the accuracy and cost-effectiveness of a requirement that storm water discharged at certain construction sites not exceed certain turbidity limits.
