Only days before Steve Jobs' promised return to Apple at "the end of June," The Wall Street Journal reported that he had undergone a liver transplantrnin Tennessee two months ago. The timing of the news seemed surgical, too: It came on June 22, a day after the debut of the lat -est iPhone, the 3GS, and two days before Apple announced it had already sold 1 million of them. Apple stock dropped by only 1.5% when the story broke but fell further the next day. Corporate governance experts fired away at Apple's board for not forcing a more forthcoming disclosure, and as of press time the company had yet to acknowledge the Journal's story. Instead, a Memphis hospital confirmed that it had done the operation. But securities lawyers say the SEC has given little guidance about when the health of a CEO becomes a material matter. And Jobs was said to be back on the job on June 21, a claim that Apple, as usual, did not confirm-but notably didn't deny either.
