U.S. Greenhouse Gas Mandatory Reporting: Prelude to Emission Reduction Rules?

Environmental regulators in the United States continue to move aggressively toward greenhouse gas (GHG) reduction through enforcement action. In contrast to Canada, where the Green Energy and Green Economy Act of 2009 gave the Ontario Government the legislative means to establish a comprehensive GHG strategy, the American Clean Energy and Security Act of 2009 (ACES), which contained GHG reduction mechanisms, continues to languish in Congress and has little likelihood of passage in 2010. Nonetheless, the U.S. Environmental Protection Agency (EPA) is moving ahead with its own GHG regulatory program, one that some say lacks formal statutory endorsement.
