The Environmental Planning and Assessment Amendment (Part 3A Repeal) Act 2011 (NSW) (the Amending Act) received Royal Assent on 27 June 2011 and will be commenced by proclamation. The Amending Act, among other things, repeals Pt 3A of the Environmental Planning and Assessment Act 1979 (NSW) (the Act) and introduces the concepts of state significant development (SSD) and state significant infrastructure (SSI). The general distinction between the two is that SSD will be private development that is of state significance and SSI will be major government infrastructure projects and other privately operated infrastructure projects. This article will provide a brief outline of how the new assessment systems will operate.
