SANTA FE, N.M.-The New Mexico Oil & Gas Association's Legal Affairs Committee has negotiated a proposed settlement with the Navajo Nation over the Indian tribe's plan to enact its own Superfund statute under the federal Comprehensive Environmental Response, Compensation and Liability Act (CERCLA)'s "treatment as a state" provision. NMOGA President Steve Henke says the settlement and an accompanying "gap filling policy" . . . "substantially address the concerns raised by NMOGA to the benefit of our members."
