President Bush on May 21 signed into law the Genetic Information Non-discrimination Act of 2008. The law prohibits group health plans and health insurance issuers offering group health insurance coverage in connection with a group health plan from adjusting premiums on the basis of genetic information. In addition, the law prohibits employers from discriminating against employees on the basis of genetic information. Employers, group health plans, and health insurance issuers offering group health insurance coverage cannot mandate genetic testing. The law, however, does not prohibit discrimination against persons whose "manifested disease, disorder, or pathological condition" has or may have a genetic basis.
