EPA's Crackdown on Electric Utilities Reaps Results

EPA issued notices of violation (NOVs) to 32 "grandfathered" electric utility power plants on November 3, 1999. The NOVs allege that the facilities had performed modifications without obtaining the appropriate new source review (NSR) pre-construction permits. As a result, the facilities had not been required to implement stringent new controls on nitrogen oxides (NO_x), sulfur dioxide (SO_2), and particulate matter (PM) emissions, as required by the CAA. In conjunction with the NOVs, EPA also filed federal complaints against seven electric utilities seeking injunctive relief and administrative penalties.
