EPA's Projection of Cellulosic Biofuel Production for 2012 Vacated

In a January 25, 2013 decision, the DC Circuit Court vacated EPA's projection of how much cellulosic biofuel would be produced in 2012 (American Petroleum Institute v. EPA, No. 12-1139 [D.C. Cir. Jan. 25, 2013]). The DC Circuit Court found that EPA's methodology for making the 2012 cellulosic biofuel projection was not neutral, and was an unreasonable exercise of agency discretion (PAGE 3.13).
