The Supreme Court has confirmed that the appeal by Prudential against the Court of Appeal's refusal to extend legal professional privilege to non-lawyers will be heard in November 2012. As reported in Accountancy June 2011 (p81), the appeal relates to a request by HMRC for Prudential to disclose tax advice provided by PwC. At the time, the Court of Appeal emphasised that it believed extending legal professional privilege in this way was a matter for parliament, not the courts. Nonetheless, leave to appeal to the Supreme Court was granted and the case will now be heard there almost two years after it came before the Court of Appeal.
