ESPORTA SUBS CASE OVERTURNED IN UT

The FTT decision in the case of Esporta has been overturned by the Upper Tribunal (UKUT0173). The club granted gym access in consideration of monthly payments under a year-long contract. If payments fell into arrears, defaulting members were not allowed to use the facilities. But, if they paid arrears and continued to pay for membership, then they would not have to rejoin and thus avoided the need to pay an entry charge.
