论遗产管理人民事责任的承担∗

摘要

In China, the legal liability that the administrator of estate should take has not been confirmed yet. By re-ferring to the related prescriptions about the civil liabilities that the administrators of estate should take in different coun-tries, it is concluded that China should build its own system about the civil liabilities of the administrators of estate by tak-ing into consideration of several elements.%目前，我国没有明确的遗产管理人应当承担的法律责任。借鉴各国遗产管理人承担民事责任的相关规定，我国立法应从遗产管理人应当承担侵权责任，适用过错责任原则，采用返还财产、恢复原状、赔偿损失的民事责任承担方式，以及基于行为符合遗产利益且善意而为和受害人过错而享有豁免责任等方面，构建我国的遗产管理人民事责任制度。
