改革开放以来我国农村宅基地管理政策体系的梳理与思考

摘要

新型城镇化背景下加强农村宅基地管理、促进城乡资源要素流动具有重要意义.本文从法律框架、党中央政策精神以及政府规范性文件三个方面梳理了农村宅基地管理政策,分析认为现有管理政策体系难以协调宅基地福利性与财产性之间的本质矛盾,难以有效地应对宅基地利用过程中的复杂性;创新宅基地管理政策体系,促进与保障农村深化改革发展成为现阶段的重要任务.%The rural homestead management system plays a signiifcant role in new urbanization. This article addresses three aspects of the rural homestead management system: the legal framework, the Party Central Committee policy, and government legislation. The study analyzes the deifciencies and consequences of the rural homestead management system, particularly the conlfict between the protection of the environment and property. The existing management policy system cannot effectively resolve complications associated with homestead utilization, and it is therefore necessary to innovate the system to promote reform and development of rural land.
