禁止农村土地承包经营权抵押的不合理性分析

         

摘要

<物权法>虽将土地承包经营权规定为用益物权,但却不允许设立抵押权.通过文献研究法研究得出禁止农村土地承包经营权抵押存在以下四种不合理性:二元模式的不合理性;法律法规的矛盾性;担心农民失地的不合理性;一刀切的不合理性.同时,禁止农村土地承包经营权抵押会产生很多负面影响,不利于农业发展、土地流转以及破坏土地权利完整性,最后,提出放开农地抵押限制的建议与措施.%Real Right Law prescribes the managerial right of contracted land as usufructuary, but permits no mortgage of it.This paper uncovers four irrationalities by means of literature study in prohibiting the mortgage of the managerial right of rural contracted land, i. e. , the irrationality of binary mode, the contradictory of laws and regulations, the unreasonableness of worrying about the losing land of farmers, and the irrationality of case-dealing in the same manner. The paper argues that prohibiting the mortgage of the managerial right of rural contracted land would produce negative effect and would go against agricultural development, land transfer and even undermine the integrity of land rights. In the end, the paper offers suggestions and measures about permitting the mortgage of agricultural land.
