从公平与效率的角度分析民商法与经济法的价值取向

摘要

Equality and efficiency constitutes an important part in the value of laws. In the first use of primary distribution, microe-conomic control and the planning of resources, the method with efficiency as the main and equality as the secondary is used; in the subsequent re-distribution, macroeconomic control and the re-planning of the distributed resources, the primary and sec-ondary positions of equality and efficiency must be replaced, and only in this way can effectively guarantee the correct value orien-tation of civil and commercial law and economic law. Besides, civil and commercial law plays a supreme role in first distribu-tion, microeconomic control and the distribution of planned re-sources;economic law plays a supreme role in the style of plan-ning and distributing resources, macroscopic field and re-distri-bution field. This paper analyzes the value orientation of civil and commercial law and economic law from the angle of equality and efficiency.%公平和效率是法律的价值的重要组成部分。在初次分配、微观调控与计划资源的第一次运用时，使用了以效率为主要，公平为次要的方法；在随后的再次分配、宏观调控与配置资源的再次计划时，就必须将公平与效率的主次位置进行交换，只有这样才能有效地保障好民商法与经济法的正确价值取向。另外，民商法在初次分配、微观调控与计划资源的配置中存在着至上的作用；而经济法则在计划配置资源方式、宏观领域以及再分配领域有着至上作用。本文就从公平与效率的角度对民商法与经济法的价值取向进行了分析。
