内地与香港铁路旅客联运法律研究

摘要

Because of a big difference between legal system in Chinese mainland and Hong Kong, it is necessary to de- termine the principle and method of solving the legal difference of the through passenger transportation by the way of a- greement. This paper researches the necessity of perfecting legal system of through passenger train between the main- land and Hong Kong, and puts forward the corresponding legislative proposals to the regulations of the through railway passenger transport based on analyzing and comparing the legal characteristics of railway passenger traffic between the mainland and Hong Kong.%香港与内地法律制度存在很大差异，要通过协议方式确定直通旅客列车在运输过程中对法律差异的处理原则和方法。探讨完善内地与香港铁路旅客直通运输法律制度的必要性，在比较分析内地与香港铁路客运法律制度特点的基础上，就完善铁路旅客直通运输法律制度等问题进行研究，提出具体的立法建议，为立法部门提供参考。
