国际铁路旅客联运立法对完善我国涉外铁路客运法规的启示

摘要

Aimed at prompting the legislation of foreign-related passenger transport in our country and based on the laws and regulations of international railway passenger joint transport, the paper analyzes connotations and features of the for- eign-related legal system from the aspects of the carriage contract, the ticket, the rights and obligations of passengers, the limit compensation liability and the responsibility of the carrier, compares with the legislation of Chinese railway passen- ger transport, draws lessons from experience of rules of international railway passenger joint transport, and puts forward the corresponding legislative proposals to perfecting the regulations of Chinese foreign-related railway passenger trans- port.%为推动我国涉外铁路客运立法，以国际铁路旅客联运法规规章为研究对象，从涉外铁路旅客运输合同、车票、旅客的权利义务、赔偿责任及限额规定以及联运承运人的责任分配与追偿等方面，分析相关法律制度的内涵、特点，通过与我国现有铁路客运立法的比较，借鉴国际铁路旅客联运立法经验，为完善我国铁路涉外旅客运输法规体系提供立法参考建议。
