旅游不文明行为记录制度的法治化

摘要

旅游不文明行为记录是旅游主管部门对游客与旅游从业人员的基本信息、旅游不文明行为的表现与后果等进行记录、公布的一种具体行政行为,具有行为上的多样性、评价上的道德性与结果上的制裁性等特点.当前,以<办法》为基础构建起来的旅游不文明行为记录制度存在合法性不足的缺陷.旅游不文明行为记录制度需要通过修改《旅游法》,在此基础上由国家旅游局通过立法程序来实现法治化.未来的旅游不文明行为记录应当朝着法律属性明确、"联合惩戒"适度以及权利救济健全有力的方向发展完善.%The record of uncivilized travel is a specific administrative act that records and publishes the basic information of tourists and tourism professionals, the performance and consequences of uncivilized behavior by tourism authorities. It is characterized by the diversity of behavior, the morality of evaluation and the sanction of the result. At present, the tourism uncivilized behavior record system constructed on the basis of "measures" is deficient in legality. Tourist uncivilized behavior record system needs to realize legalization by the national tourism administration amending the tourism law through legislative procedures. In the future, the record of uncivilized behavior should be well developed in the direction of clear legal attribute, moderate punishment and sound right relief.
