“先占原则”不应成为日本侵略他国的说辞--从1874年日本侵台之役说起

At the end of the Shogunate,Japan had a preliminary touch with the preemption principle of the modern international law,but didn’t take a great interest in it.After Meiji Restoration,the desire to annex Ryukyu prompted Japan to study the knowledge of the preemption principle,and started a war to invade Taiwan on the excuse that it was a tributary without owners.Through the war,Japan had been acquainted with the preemption principle to invade other countries,and successfully applied it to the activity of secretly occupying Diaoyu Islands of China.%幕府末期，日本与近代国际法的先占原则有过早期接触，但未对其产生浓厚兴趣。明治维新后，日本出于吞并琉球的需要，促使其搜寻近代国际法中有关先占原则的知识，并以台湾“番地”无主为借口发动侵台战争。通过该役，日本掌握了以近代国际法的先占原则侵略他国的精髓，并将其成功运用到窃占我国钓鱼岛列岛的行动中。
