The conlfict due to urban-rural spatial growth intensiifes under current rapid modernization and urbanization, which is taking the form of rural construction land that is being illegally occupied and the popularity of rural self-built housing. Although China has adopted a series of top-down approaches aimed at historical towns and villages to traditional villages, the main idea of which remains regarding traditional villages as cultural relics, ignoring its vitality and systematicness. The defect results in insufficiency pertinence of traditional village protection system and continual destruction of traditional villages. In this paper, based upon essential issues of the conlfict between traditional villages protections,new thinking of developing traditional villages is proposed.%快速城市化背景下，我国传统村落面临快速消失和濒临破坏的困境，自破坏和他破坏现象层出不穷，现有部分传统村落能够保留下来多数并非法律制度管控下的主动性保护结果，而是消极状态下的遗漏性遗存使然。虽然我国已经构建了从历史文化名镇名村保护到传统村落保护的自上而下的双轨制政策体系，但保护制度的系统性、协调性不足，忽略了本身的生命性特质，未解决传统村落现实保护和发展过程中存在的两个极端问题：在理论上作为文物的过度保护和实践上作为旅游商品的过度开发。本文从反思传统村落保护制度的矛盾问题入手，提出具体的创新建议。
