我国地方职业教育法律制度创新

摘要

The current vocational education development in our country encounter “four big bottleneck” and it is in urgent need the innovation and support of the legal system to break the dilemma. The innovation of vocational education legal system is a profound and progressive system revolution. The lagging and lack of central legislation have been unable to adapt to the new development and new situation of vocational education. However,the innovation of local legislation practice made a positive response. The occurrence of the innovation of local vocational education legal system including internal and external motivations ,but it is constrained by the factors such as mode of legislative system ,concept of traditional culture and labor recruitment mechanism. The innovation of local vocational education legal system creating a favorable environment and external environment , and forming a two-way interactive mechanism of top-down and bottom-up on the basis of improving the local legislation mode,update the idea of vocational education and the strict employment admittance system.%我国当前职业教育发展遭遇“四大瓶颈”，破解困局急需法律制度的创新和支撑。职业教育法律制度创新是职业教育领域的一场深刻的、渐进的制度革命，中央立法的滞后与缺失已无法适应职业教育的新发展、新情况，而地方立法的创新实践进行了积极回应。地方职业教育法律制度创新的发生存在内外部动因，但受到立法体制模式、传统文化观念、劳动用工机制等因素的制约。地方职业教育法律制度创新在改进地方立法模式、更新职业教育观念、严格就业准入制度的基础上，营造良好的氛围和外部环境，形成自上而下与自下而上的双向互动机制。
