高校招生竞争失范的法律经济学分析

摘要

Anomie in college admissions competition is the product of specific background, whose forms include misleading propagand, high paid for admission, damaging the reputation of others. Anomie causes great transaction costs, so the government should undertake governance. The causes of the anomie include information asymmetry, comparative gain from the prisoner's dilemma, the lack of competition law. Following the Coase Theorem and Hobbes Theorem on the law and economics, it is necessary to perfect relevant legislation as soon as possible, to dredge the channel for information transmission in college admissions, to increase colleges' opportunity cost of illegal behavior,so the anomie behavior can be contained.%高校招生竞争失范行为是特定背景下的产物，表现为虚假宣传、高额有偿招生、声誉诋毁等多种形式。招生竞争失范导致了巨大的交易成本，需要政府出面进行治理。失范原因包括双方信息不对称、存在基于囚徒困境的比较收益、竞争法律制度缺失等。遵循法律经济学上的科斯定理和霍布斯定理，要尽快完善相关立法，打通招生领域的信息渠道，增加高校违法招生竞争的机会成本，以遏制失范行为的发生。
