药品责令召回的法律属性及其适用

摘要

The legal nature of the mandated drug recall system is not accurate, which causes the uncertainty in law-applying .This paper well discuss the the nature of the mandated drug recall, and then specify the application of the commanded drug recall.The author believes that the nature of the commanded drug recall is executive order, which should further clarify its subject, procedure, and proposes the construction of the system envisaged in order to make contributions to the improvement of the commanded drug recall system.%目前学术界对药品责令召回制度的法律性质还没有准确界定,导致其在法律适用的主体、程序方面的不确定. 药品责令召回的法律属性应当属于行政命令,因而在适用问题上首先应明确监管主体的级别管辖原则和地域管辖原则,其次应当在药品责令召回的程序设计中增添制药企业的权利保障制度.
