析专家辅助人在医疗损害诉讼中的地位和作用

摘要

目前我国的鉴定制度不完善，鉴定意见颇受争议，涉及鉴定案件的审理显得十分困难。本文通过英美法系的“专家证人”、大陆法系的“技术顾问”，对比我国的专家辅助人，并结合证人、鉴定人和诉讼代理人的性质、特征对专家辅助人在诉讼中的地位和作用进行分析，为充分发挥专家辅助人在医疗损害案件诉讼中的作用提供对策，以期为我国医疗损害案件诉讼中专家辅助人制度的理论和实践操作提供有益的参考。%Currently identification system in China is inadequate, and expert opinions are controversial, which makes it difficult to try cases involving identification. This paper compared "expert witnesses" of common law system and"technology consultant"of the continental law system with expert assessor in our country, analyzed expert assessor's status and function obtained from in lawsuits the witnesses, expert witnesses and solicitors, and provided countermeasures for expert assessors to give full play in medical injury cases, expecting to provide useful reference for theory and practical operation of expert assessor system in medical injury cases in China.
