文章以“受害人承诺”的含义及该承诺的成立要素、细节反思等为切入点，首先对受害人承诺的构成要件进行了丰富和细化，对与医疗刑法相关的若干质疑进行了梳理；其次对安乐死合法化的正当性依据、适用标准展开了详细论述和充分论证，在赞成安乐死合法化的立论基础上，通过归纳、总结等，谨慎构建了关于我国积极安乐死和消极安乐死各自的立法根基和执行准则；最后以理论和实践中争议较集中的器官移植为又一探讨目标，以对比分析为基本思路，对与器官移植相关联的新型犯罪规制进行了细致、深入的法律解读。%Taking the meaning, established elements and details reflection of the victim's consent as the entry point, this paper firstly enriched and refined the opponents of the victim's consent, and combed some questions related with medical criminal law; then described in details and fully demonstrated the legitimacy basis and the applicable standard of the legalization of euthanasia, on the basis of being in favor of the legalization of euthana-sia, through such means as generalizations, this paper carefully constructed legislation foundation and implemen-tation guidelines of active euthanasia and passive euthanasia in China respectively; finally, aiming at organ trans-plantation which is controversial in theory and practice, taking comparison and analysis as the basic train of thought, this paper gave detailed legal interpretation on a new type of crime associated with organ transplant.
